I would guess they just decided to use the name of the album and no one has bothered suing them. They may not even have known about the post-AC band.

Right off the bat, there are too many similarities...."Election Day"=elected....."The Nightmare Began"....really, nightmares? ...the album cover....could it be Sister Sara?.....IMO they should do more work on subject matter and presence to prevent any misunderstanding....but, it's gonna happen.

A sparce bank account associated with them may also be part of the consideration. No money to be had, no reason to go to the expense of suing. Also, the guys may have wanted to see the name live on!

This band has been around for about 10 year. They have never nor will they ever amount to anything in the U.S. which is where the trademark issues would essentially be an issue, but there are also quite a few bands with names preciously used by bands may years ago.
